- Stella subscribes to Independent Football Australia Limited (“IFA”) and is a Member under its Constitution.
- To qualify as an approved IFA Member Stella complies with the Academy Acknowledgement – IFA Membership. This includes an undertaking by Stella that its registered players (and their parents and or guardians) have read and acknowledge:
- Player Consent Agreement – IFA Competitions
- IFA's Code of Conduct
- IFA Cup Matchday Rules as they apply to the relevant “Competition”.
- As a participant in IFA competitions, Stella agrees to be bound by the IFA Competition Entry and Participation - Terms and Conditions.
- By registering with Stella and participating in any sanctioned Stella training, competition or other event, the player (their parent and/or guardian) agree to the terms and conditions as set out in 1 to 3 above, and the additional provisions that follow.
Code of Conduct
- The player (their parent and/or guardian) has read and agrees to be bound by Stella’s Code of Conduct and IFA's Code of Conduct. The player (their parent and/or guardian) is responsible for disseminating the codes to any spectator.
- Stella reserves the rights to expel any player for breaches of the codes and shall be guided by the officials of any competition in which Stella participates as to sanctions for breaches of their respective codes.
Participation
- The player (their parent and/or guardian):
- have been or are declared physically fit and able to participate in football training and competitions.
- will promptly inform Stella of any medical conditions, injuries or any medications that may affect my participation.
- are aware that football training and related activities involve physical exertion, movement and contact which collectively may result in injury.
- voluntarily accept the risk of physical injury, including serious injury such as permanent disability, paralysis or even death.
- in the event of a serious injury or medical situation authorise Stella or its agent, or sanctioned competitions’ agent, to render medical assitance.
- The selection of players in teams, grades and competitions, and the allocated game time and or position of the player remains solely at the discretion of Stella.
Fees
- The player (their parent and/or guardian) agrees to pay the registration fees for the programme in which they enrol through the registration portal. Timing and method of payment will be set out in the invoice.
- If you register for a program, you will be required to pay the full program fee, and no refund will be provided due to early termination of the program unless there are any extenuating circumstances or as required by the law.
If such extenuating circumstances eventuate, you will be asked to provide supporting information as evidence. If satisfied, we will provide a credit for that amount of the fee that represents the unused portion of the program (less registration and uniform fees) and Stella will specify how the refund was calculated.
Stella retains the right to determine if the circumstances that warrant the crediting of fees.
- If you are experiencing hardship, please email [email protected] so that we can arrange a suitable payment plan. A late payment fee may be added to all overdue invoices.
- If your overdue account is referred to a collection agency and/or law firm, you will be liable for all costs which would be incurred as if the debt is collected in full, including legal demand costs.
Apparel and equipment
- Players are required to train and compete in Stella approved kits. As part of the Players’ registration fees, they will receive approved kits. Should the player lose items they may repurchase them via the Stella Shop.
- All players should wear boots and shinpads to training and games.
Weather and other force majeure events
- Stella is guided by competition organisers, peak bodies and authorities as regards extreme weather conditions or events which may cause it to be unsafe to participate in football training or competitions.
- In following that guidance, Stella may cancel training sessions, games or competitions due to weather, ground closures (as directed by third parties), pollution, and other events such as civil unrest and or pandemics.
- In the event of the aforementioned Stella will communicate the cancellation (and reason for same) as soon as practicable to parents via the usual communication platform.
- Where possible and within the control of Stella, it may reschedule sessions, games, competitions or venues. If however, Stella cannot reschedule sessions, games, competitions or venues there will be no refund of fees.
Privacy and intellectual property
- Stella’s privacy policy may be found here.
- All intellectual property is licensed to Stella who confers no interest in that intellectual property which in-turn is protected by Australian and international copyright and other intellectual property laws. You may not do anything which interferes with or breaches those laws or the intellectual property rights in Stella’s content.
- Stella will regularly take photos of players for marketing purposes and publicise same across all forms of media including websites and other social media platforms.
- Stella consents to same in competitions in which it participates, or hosts, including but not limited to IFA the terms and conditions may be found here for that competition: Player Consent Agreement – IFA Competitions. The player (their parent and/or guardian) accept that they could be photographed at any time for this purpose.
- If the player (their parent and/or guardian) does not consent they must notify Stella prior to registration in a programme at [email protected]. Whilst best endeavours will be exercised to prevent the participant being photographed and images being publicised, we cannot guarantee they will not be.
Insurance
- Stella maintains insurance as required by law and under contract in connection with its services as a football provider, academy and competition facilitator.
- Stella does not have in place personal accident insurance policy covering the player for out-of-pocket medical expenses following an injury arising from participation in football training or competition.
- Stella strongly recommends that all participants have the benefit of private health insurance, this insurance being in addition to Medicare. The player (their parent and/or guardian) acknowledge that any injury or incident requiring medical assistance will in the ordinary course be covered by Medicare and Private Health insurance. Some injuries may result in an additional expense to the player.
Liability
- It is the responsibility of the player (their parent and/or guardian) to ensure they are appropriately hydrated, maintain adequate nutrition and if required, protect themselves from weather. Stella has no liability for their player’s inaction in respect of the above.
- Stella has no liability for dissemination of imagery of any participant, player, spectator or otherwise on any public forum.
- Stella has no liability for any expenses incurred that would ordinarily be covered by private health insurance (in the event the player does not have the benefit of that cover) nor will it have liability for any additional out of pocket expenses that would not be met by Medicare or Private Health Insurance.
- Stella has no liability for any personal items lost or damaged during training or competitions. At is discretion Stella may dispose of lost property after 14 days.
- Stella will exercise best endeavours to ensure the delivery of training, games and competitions, however, accepts no liability for loss, damages, costs or expenses (including refunds or credits) where it cannot deliver training, games and or competitions due to matters outside of its control.
- The player (their parent and/or guardian) unequivocally agrees to release and hold harmless Stella, its directors, employees, contractors, consultants and agents from all liability in connection with personal injury, property damage or financial loss (including damages, costs and expenses) arising from or in connection with all participation in any Stella sanctioned, training or competition. The above indemnity shall only apply to the extent Stella’s negligence does not cause or contribute to the loss, and provided that, indemnity is available for such loss under Stella’s insurance policies.
